1. Definitions & Interpretation

In these Terms and Conditions, the following definitions apply:

  • “Company”, “we”, “us”, “our” means Wide Wings Tiles Ltd, registered in England and Wales, Company Number 08826357, VAT Number GB318131726, whose registered office is at 29 Croft House Way, Morley, Leeds, England, LS27 8UA and whose trading address is Unit 1 Scotch Park Trading Estate, Forge Lane, Leeds, LS12 2PY.
  • “Customer”, “you”, “your” means any individual, company, trade customer, or other entity placing an order with us.
  • “Consumer” means a Customer who is a natural person acting outside of their trade, business, or profession.
  • “Trade Customer” means a Customer purchasing goods wholly or mainly for the purposes of their trade or business.
  • “Goods” means the tiles, paving, materials, and any other products supplied by us.
  • “Order” means any purchase made in person at our showroom, by telephone, or by email.
  • “Website” means www.widewingstiles.co.uk, which is an information and catalogue site only. No contractual purchases are made through the website.

2. Basis of Contract

  • These Terms and Conditions apply to all orders placed with us and supersede any previously issued terms or any terms proposed by the Customer.
  • A contract is formed between us when we confirm your order in writing (by email or invoice) and accept payment or confirm credit terms.
  • Our website is a catalogue and information resource only. No contract is formed by browsing our website or making an enquiry.
  • We reserve the right to decline any order at our absolute discretion without obligation to provide a reason.
  • Any quotation issued by us is valid for 14 days from the date of issue and is subject to stock availability. A quotation does not constitute an offer or binding contract.

3. Pricing & Payment

  • All prices are quoted exclusive of VAT unless expressly stated otherwise. VAT will be charged at the prevailing rate applicable at the date of invoice.
  • Prices are subject to change without notice until an order is confirmed in writing by us.
  • Full payment is required before goods are dispatched or made available for collection, unless a credit account has been approved in writing by us.
  • Credit accounts are available exclusively to approved wholesale and shop customers and are subject to satisfactory credit insurance assessment. We reserve the right to withdraw or reduce credit facilities at any time without notice.
  • Credit account customers must pay within the agreed credit terms stated on their invoice. Late payment will attract interest at 8% per annum above the Bank of England base rate under the Late Payment of Commercial Debts (Interest) Act 1998.
  • We reserve the right to suspend or cancel any outstanding orders where payment has not been received in accordance with agreed terms.
  • All payments must be made in pounds sterling (GBP). We accept bank transfer (BACS) and such other payment methods as we make available from time to time.

4. Orders & Availability

  • All orders are subject to stock availability. We will notify you promptly if goods are unavailable or subject to delay.
  • We strongly advise ordering a minimum of 10-15% more tiles than your measured requirement to account for cuts, breakages, and future repair needs.
  • We strongly advise ordering all tiles required for a project in a single order from the same batch. Tiles ordered at different times may come from different batches and may exhibit colour, shade, or tonal variation. We accept no liability for such variation.
  • We reserve the right to make reasonable substitutions where a product is discontinued, provided we notify you and the substitution is of equivalent or greater specification and value.

5. Delivery

Delivery terms are set out in full in our Delivery Information document, which forms part of these Terms and Conditions. Key provisions are summarised below:

  • Delivery is kerbside only via 18-tonne pallet courier vehicles with tail lift. It is your responsibility to ensure suitable access.
  • Someone must be present to accept delivery. We accept no liability for goods left unattended or damaged where no authorised person was present.
  • Delivery timescales are estimates only. We shall not be liable for consequential losses arising from late delivery.
  • Risk passes to you upon delivery. Title passes upon receipt of cleared payment in full.

6. Inspection & Acceptance

  • You must inspect all goods upon delivery and report any damage or shortage within 24-48 hours with photographic evidence. Full terms are set out in our Damages Policy.
  • Goods will be deemed accepted by you if: (a) you sign for delivery without noting damage; (b) you do not report damage within the 24-48 hour window; or (c) you install any tiles without first reporting a defect or damage.
  • Once tiles have been installed, you are deemed to have accepted them in full, irrespective of any defect, damage, or colour variation. No claim will be accepted after installation.

7. Returns & Refunds

Full returns terms are set out in our Returns & Exchanges Policy, which forms part of these Terms and Conditions. Key provisions are:

  • Returns accepted within 30 days for unused, original-condition goods only.
  • A 25% restocking fee applies to all non-faulty returns. Return delivery costs are the customer’s responsibility.
  • Change of mind returns: original outbound delivery charge is non-refundable and return costs plus restocking fee apply.
  • Special orders, sale items, and installed tiles are non-returnable.
  • All refunds are by BACS transfer only within 14 days of approved return inspection.

8. Product Information & Suitability

  • Any advice, recommendation, or guidance provided by our staff is offered in good faith as general guidance only and does not constitute professional installation or structural advice.
  • It is the Customer’s sole responsibility to ensure that tiles selected are suitable for their intended purpose, application, environment, and surface. We strongly recommend consulting a qualified tiler and reviewing product specification sheets before purchase.
  • Natural variation in colour, shade, texture, tone, and finish is inherent in ceramic, porcelain, and natural stone products and is not a defect. Images on our website and brochures are representative only.
  • We do not guarantee that product descriptions, dimensions, or specifications on our website are error-free. If precise specification is critical, please verify with us directly before ordering.

Important: Samples, photography, natural variation, and batch-to-batch differences may affect the appearance of tiles. Customers should always satisfy themselves as to suitability, quantity, and batch consistency before installation.

9. Limitation of Liability

Our total liability to you in connection with any order shall not exceed the total price paid by you for the specific goods giving rise to the claim.

  • Wide Wings Tiles Ltd shall not be liable for any indirect, consequential, special, or incidental losses arising from the supply or use of our goods, including but not limited to: labour or installation costs, contractor standing time, removal and re-installation costs, accommodation costs, loss of profit, loss of use, project delays, or any other consequential financial loss.
  • We shall not be liable for losses arising from: incorrect installation; failure to prepare surfaces adequately; failure to follow manufacturer guidelines; use of inappropriate adhesive or grout; or any other misuse of our products.
  • We shall not be liable for losses arising from our reliance on incorrect information provided by you, including incorrect measurements, access information, or delivery details.
  • Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
  • Consumer Customers retain all rights under the Consumer Rights Act 2015 and other applicable consumer protection legislation. These terms do not affect those rights.

10. Indemnification

You agree to indemnify, defend, and hold harmless Wide Wings Tiles Ltd, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your breach of these Terms or your violation of any applicable laws.

Without limiting the foregoing, you specifically agree to indemnify Wide Wings Tiles Ltd and its approved haulier against any claim brought by any third party arising from: (a) Products left at kerbside following an unattended delivery; (b) your failure to ensure a responsible adult was available to receive the delivery; or (c) your failure to promptly secure Products from the kerbside.

11. Intellectual Property

All content on our website including images, text, brochures, product descriptions, and the Wide Wings Tiles brand are the intellectual property of Wide Wings Tiles Ltd or our licensors. You may not reproduce, copy, or use any such content without our prior written consent.

12. Fraudulent or Invalid Claims

We operate with integrity and expect the same from our customers. Where we reasonably believe a claim — whether for damage, defect, non-delivery, or any other matter — is fraudulent, exaggerated, or made in bad faith, we reserve the right to:

  • Reject the claim in its entirety without refund or replacement.
  • Terminate any ongoing or future business relationship immediately.
  • Withdraw all credit and account facilities with immediate effect.
  • Pursue legal action and/or report the matter to relevant authorities including the police where fraud is suspected.
  • Recover the cost of any goods already provided or refunds already issued on the basis of a claim subsequently found to be fraudulent.

13. Force Majeure

We shall not be in breach of contract or liable for any delay or failure to perform our obligations where such failure is caused by events beyond our reasonable control, including acts of God, extreme weather, pandemics, supply chain disruption, carrier failure, or government restrictions. We will notify you and seek to fulfil obligations as soon as reasonably practicable.

14. Governing Law & Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any dispute arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to These Terms

We reserve the right to update or amend these Terms and Conditions at any time. The version in force at the date of your order will apply to that order. We will publish the current version on our website and make it available on request.
